Terms and Conditions of Contract

These Terms and Conditions apply when MacKenzie Land Ltd is instructed to carry out a survey of a commercial property for the purpose of producing a Non‑Domestic Energy Performance Certificate (EPC). By granting access to the premises for survey, the Client accepts these Terms in full. Terms relevant to our other services, i.e. Display Energy Certificates, Drone inspections are listed near the end of these terms.

1. Scope of Service

We undertake non‑intrusive, visual commercial energy assessments only. A full survey of the premises is required in order for us to produce the EPC. Any questions regarding the survey process or these Terms must be raised and resolved before the survey is conducted.

2. Quotations and Accuracy of Information

We rely on the Client to provide a reasonable and accurate description of the premises when requesting a quotation. If the description provided is significantly inaccurate, we reserve the right to amend our fee accordingly.

Where we have carried out our own investigation to provide an accurate quotation, this will be stated within the quote.

3. Payment Terms

Payment is due immediately upon completion of the survey, regardless of whether the EPC can be completed at that time.

Once the site has been attended for the purpose of survey, the full agreed fee becomes payable.

If the survey cannot be completed due to conditions outside our control—including but not limited to health & safety concerns, lack of access, or missing information—our full fee remains payable.

Invoices must be settled immediately upon receipt. Invoices unpaid after two weeks will accrue interest as permitted by law. If debt recovery action is required, all associated costs will be added to the outstanding balance.

4. Access Requirements

The Client must ensure that the building and all relevant areas are accessible for inspection. Any obstruction preventing a complete survey may result in:

  • The full survey fee remaining payable

  • Additional charges for revisits

  • Use of default data, which may negatively affect the EPC rating

We are not responsible for moving, clearing, or adjusting any items, stock, equipment, or fixtures to gain access.

5. Health & Safety

The Client must inform us of any health and safety matters relevant to our attendance on site.

If any unreasonable or unsafe conditions come to our attention—including asbestos, unsafe structures, or other hazards—we will leave the site immediately. We will not revisit until the issue has been satisfactorily resolved. Access charges for any return visit will be payable in addition to the original fee.

We will report any health and safety concerns we observe during the survey.

6. Liability

We conduct non‑intrusive commercial energy surveys only. Our assessments are visual and do not require the movement, disconnection, shutdown, or interference with any equipment, fixtures, fittings, electrical appliances, refrigeration units, or stored goods. We will not carry out any intrusive actions that may cause material disruption to the Client’s premises.

While reasonable care is taken during site access, we accept no responsibility or liability for any material damage, loss, deterioration, spoilage, or operational impact affecting the Client’s property, equipment, stock, or fixtures during or after the survey.

It is the Client’s responsibility to ensure that all perishable goods, temperature‑sensitive items, and any equipment used to store or protect such goods are appropriately safeguarded before, during, and after the survey. This includes enforcing their own internal procedures, access controls, and protection regimes. We will not be liable under any circumstances for damage, spoilage, deterioration, or loss of perishable goods.

No observation, comment, or presence on site shall be interpreted as an assumption of responsibility for the condition, operation, or performance of any equipment, appliances, or stored goods.

We do not accept liability for consequential loss, business interruption, or financial loss arising from the survey or any site conditions encountered.

7. Delivery of EPC

We will undertake the survey and produce the EPC within a reasonable timeframe, typically within 3–5 working days unless otherwise agreed. If any issue arises that may delay delivery, we will inform the Client and provide a revised completion date.

8. Liability for Instructing Entities

Where we are instructed to invoice a Limited Company, LLC, Pension Fund, SIP Pension, or similar entity, the instructing individual remains jointly liable for all fees until the invoice has been settled in full by the invoiced entity.

9. Issue of Certificate

Upon completion of the survey, we will issue the EPC and any associated documentation immediately, together with our invoice. Payment is due upon receipt.

Additional Service‑Specific Terms

Display Energy Certificates (DECs)

All clauses within these Terms and Conditions apply equally to Display Energy Certificate assessments and Advisory Reports. DEC surveys are non‑intrusive and visual in nature. The Client must ensure full access to all relevant areas, metering information, and operational data required to complete the assessment. Any lack of information may result in the use of default values, which may negatively affect the DEC rating.

Drone Surveys and Aerial Inspections

Drone surveys are conducted strictly as non‑intrusive observational inspections. We do not move, alter, or interfere with any building elements, fixtures, or equipment. All liability exclusions stated in these Terms apply equally to drone operations, including but not limited to:

  • Material damage to property

  • Disturbance to stock, equipment, or fixtures

  • Loss or spoilage of perishable goods The Client is responsible for ensuring safe access conditions, airspace suitability, and the protection of any goods or equipment that may be sensitive to vibration, airflow, or proximity during aerial operations. We accept no liability for any consequential loss or business interruption arising from drone activity.

Other Services

Any additional services provided by Click4CommercialEPC (MacKenzie Land Ltd) — including surveys, inspections, advisory work, or documentation — are subject to the same Terms and Conditions outlined above unless otherwise agreed in writing.
